Terms of Service

Welcome to Sitewise. These Terms of Service (“Terms”) govern your use of the Sitewise mobile application and related services (collectively, the “Service”) operated by Sitewise (“Sitewise”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account

You must provide accurate information when registering and keep your sign-in credentials confidential. You are responsible for all activity on your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

2. Your content

Photos, voice notes, sketches, text notes, GPS coordinates, and other material you capture or upload through the Service (“Your Content”) remain yours. You grant Sitewise a worldwide, royalty-free, non-exclusive license to host, store, transmit, and process Your Content solely to operate the Service for you and your designated recipients. We do not sell Your Content, and we do not use it to train machine-learning models.

3. Acceptable use

You agree not to:

• upload content you do not have the rights to capture or share;
• use the Service to violate any law, regulation, or third-party right;
• attempt to reverse-engineer, scrape, or otherwise interfere with the Service, except as permitted by applicable law;
• resell or sublicense the Service without our written permission.

4. Fees

The Service is offered free of charge during the current preview period. We may introduce paid plans in the future and will give existing accounts advance notice before any charges begin. Payment processing, when applicable, is handled by the Apple App Store under its terms.

5. Service availability

We work to keep Sitewise running smoothly but we do not guarantee uninterrupted access. We may add, modify, or remove features at any time. Your captures sync when the device is online; offline captures are stored locally on your device until a connection is available.

6. Termination

You may delete your account at any time from the Settings screen in the app or by emailing [email protected]. We may suspend or terminate accounts that violate these Terms. On termination we will delete Your Content within 30 days, except where retention is required by law.

7. Disclaimers and liability

The Service is provided “as is” without warranty of any kind. To the maximum extent permitted by law, Sitewise is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or business opportunity. Our aggregate liability for any claim relating to the Service is limited to the greater of US$100 or the amount you paid us in the 12 months preceding the claim.

8. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in San Francisco County, California.

9. Changes

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use of the Service after a change means you accept the updated Terms.
